STANDARD TERMS AND CONDITIONS

Specific to the AfriGay Mauritius taking place at Ambre Resort & Spa, Mauritius from 2 – 7 March 2020

  1. The AfriGay Mauritius Event
    • The AfriGay Mauritius is organized and promoted by The Travel & Event Company. 
    • The organizers reserve the right, without notice, to:
      • Cancel the event due to non-performance of sales and lack of interest;
      • Change the itinerary of the event if required;
      • Change the venue of the event, at no additional cost to the traveler;
      • Change the advertised celebrities, VIP’s and sponsors. 
  2. Event Cancellation
    • Should the event organizers cancel the event due to a lack of interest, non-performance in sales resulting in too few guests booking for the event, or for any other reason out of their control; the guest / traveler may continue to travel to Ambre Resort on the dates specified as an individual holiday, with no compensation from the organizers, in respect of the package price paid and the flights booked. 
    • In the unlikely event that this happens, all AfriGay Mauritius events, activities and celebrity appearances will be cancelled, with no compensation to the guest / traveler. The All-Inclusive package, return airport transfers and 5 night accommodation from 2-7 March 2020 will be honoured, if they guest / traveler has paid in full.
  3. Transport
    • All tours and packages sold by The Travel & Event Company, AfriGay & World Leisure Holidays for the AfriGay Mauritius Event exclude all flights and airport taxes, unless otherwise specified in the itinerary;
    • Ground transport in the form of shared return airport transfers from the airport to Ambre Resort & Spa will be provided as specified in the itinerary;
    • The Travel & Event Company can arrange for flight bookings if required, at an additional cost to the cost of the tours. 
  4. Reservations
    • A deposit payment received by The Travel & Event Company will provide an unconfirmed reservation;
    • A deposit payment received by The Travel & Event Company will hold the reservation in the name(s) of the traveler(s); 
    • Reservations will only be confirmed once the payment has been received in full. 
  5. Payment requirements, as stipulated by World Leisure Holidays & Sun Resorts
    • non-refundable, non-transferable deposit of 25% of your total tour price is required within 10 days of making a reservation. The balance to be paid 90 days prior to departure date. 
    • World Leisure Holidays has the right to cancel a reservation if they do not receive the total amount due by the relevant due date. If this happens, the cancellation clause below will apply and any deposit received will be applied against the new amount due.
  6. Package Prices
    • Package prices advertised on www.afrigay.co.za are negotiated rates specific to the AfriGay Mauritius Event and are valid until 31 January 2020. Bookings made after 31 January 2020 are subject to a new price. 
    • This is not applicable to any airfares or airport taxes.
  7. Exclusions
    • The AfriGay Mauritius package prices do not include flights, airport or tourist taxes, costs of getting passports, visas, telephone calls, laundry, entertainment arrangements outside of the AfriGay Mauritius planned entertainment, meal & beverages that fall out of the Ambre Resort & Spa All Inclusive Package, additional excursions, or any other costs you may incur (unless these have been specified in your itinerary), as well as personal items.
  8. Hotels
    • World Leisure Holidays and our agents have the right to substitute hotels with a similar category of hotel or to upgrade to a higher category at no extra cost to you, if we need to. We will try to give you as much notice as possible, 
    • Hotels have the right to close their facilities without notice, if they face operational issues. Such, facilities and amenities may change without notice.
  9. Cancellations by World Leisure Holidays
    • In line with procedures followed by global tour operators, World Leisure Holidays may identify exceptional circumstances in which they need to cancel a tour prior to departure. 
    • If this happens, all amounts received for the booking, including the deposit, will be refunded to you. This will be considered full and final settlement of any liability of any kind, however it may arise, relating to the cancellation.
    • Under normal circumstances, all deposits are non-refundable / non-transferable.
    • Should this occur, the decision lies entirely with World Leisure Holidays. The Travel & Event Company and AfriGay are excluded from such decisions and cannot be held liable for any costs incurred due to such a decision being made by World Leisure Holidays.
  10. Cancellations by the guest / traveler
    • If you cancel your booking trip, the following cancellation fees apply, over and above the deposit.  Air-tickets are excluded from this and are not linked to the AfriGay Mauritius booking whatsoever.
      • Cancellation received within 2 weeks of departure:      100% of total package price
      • Cancellation received 2-4 weeks before departure:     50% of total package price
      • Cancellation received 4-8 weeks before departure:     25% of total package price
    • In all circumstances the guest / traveler will be liable for the difference between the above amount and any deposits we have received.
  11. Travel Insurance
    • The Travel & Event Company offers travel insurance for all South African passport holders or foreign passport holders with a valid South African resident stamp. Hollard Travel Insurance underwrites this insurance. For more information about this insurance policy, contact us.
    • Travel Insurance is not compulsory but essential and it is strongly recommend that you be adequately covered by appropriate travel insurance. The Travel & Event Company and World Leisure Holidays will accept no liability before/after travel if sufficient travel insurance is not purchased.
  12. Amendments
    • An amendment fee of R450 applies to each change that is made to a confirmed reservation. 
    • Amendments must be made within 6 weeks of departure, and may attract the cancellation fees mentioned in Clause 10, as well as the above amendment fee. 
    • The Travel & Event Company takes no responsibility for cancellation or amendments to airfares if we did not book the flight. 
  13. Late Bookings
    • Reservations for AfriGay Mauritius will remain open until 20 February 2020. Payment in full will be required, based on a new quoted price upon booking. 
  14. Delays
    • The Travel & Event Company & World Leisure Holidays cannot be held responsible for any delays before departure, or during the course of our tours, if these are caused by technical difficulties at airports or by airlines, strikes, weather conditions or any other circumstances that are beyond our control.
  15. Force Majeure (“Superior Force”)
    • The Travel & Event Company & World Leisure Holidays will not be held responsible, or pay any compensation, if the performance of our contractual obligations is affected, cancelled, delayed or otherwise impacted upon by Force Majeure. 
    • The latter includes, but is not limited to, unforeseen circumstances, war, threat of war, riot, civil or political unrest, terrorist activity, industrial dispute, natural or nuclear disaster, bad weather conditions, closure of airports, air traffic control delays, rescheduling of flights, hotels or airlines overbooking and technical problems.
    • Any decision made in respect of tour services by independent operators to re-route or amend the itinerary due to any of the above or similar circumstances is at the discretion of the service provider and we shall not be liable for any claim whatsoever arising from such events. World Leisure Holidays will nevertheless use our best endeavors to obtain a refund or replace the holiday – always remembering we are at the mercy of the supplier.
  16. Unused Services
    • No refunds will be paid for unused services, whether or not these are part of the basic package, and whether or not they are pre-booked optional arrangements.
  17. Documentation
    • It is the guest / travellers’ responsibility to ensure that all travelling parties have the correct documentation before departure. This includes, but is not limited to, passports, visas, health certificates and inoculation certificates. 
    • The Travel & Event Company & World Leisure Holidays are not responsible for any consequences that may arise if there is failure to comply with the necessary health / passport / visa / re-entry permit requirements of Mauritius. Passports must be valid for at least 6 months after the return date. 
    • All travel documents, including air tickets, must reflect the exact name and surname of the passenger, as reflected in the passport. 
    • It is important to check the information in ALL travel documentation IMMEDIATELY upon receipt to ensure that all details are exactly as requested.
  18. Responsibility Clause
    • The Travel & Event Company, World Leisure Holidays and all associated companies and agents, act as agents and facilitators for carriers and ground operators. The Travel & Event Company & World Leisure Holidays as such does not own, manage or operate aircraft, transport or hotels and merely facilitates access to and use of such facilities
    • The condition for this is that neither The Travel & Event Company nor World Leisure Holidays will be held liable for any injury, damage, loss, accident, delay or other irregularity that may happen due to ground operators’ defect/s, other than liability in terms of section 61 (1) of the Consumer Protection Act (CPA). This may occur in any vehicle or other form of carriage or by error by any company or person engaged in conveying a passenger, while carrying out a tour or participating in any activity. World Leisure Holidays do however acknowledge that they may be held liable for injury or death due to their error or omission. The Travel & Event Company will not be held liable for injury or death due to their error or omission.
    • The airlines concerned cannot be held responsible for any act, omission or event while you are not on board the aircraft. The passenger tickets issued by the airline are the sole contract between the airline and the person who bought those tickets. These tours may be sold in conjunction with the services of any IATA airline.
    • World Leisure Holidays acts only as agents for the owners, contractors and suppliers of transportation and/or other related travel services provided and assumes no responsibility for the loss or damage to baggage or property or for any injury, illness or death or for any damages or claims whatsoever caused directly or indirectly from accidents, loss or damage to person or property, delays, transport, failure, strikes, wars and uprisings or acts of God over which we have no control.  
  19. Hotel Check-In/Check-Out
    • Check-in is usually after 3pm (this may be delayed during peak season) and check-out is usually before 11am. To avoid inconvenience, please confirm these times with the specific hotel.
    • We will endeavor to provide an earlier check-in for AfriGay Mauritius Event guests, but cannot guarantuee such a request. 
  20. Method of Payment
    • All payments for the AfriGay Mauritius Event must be made through the online payment gateway on www.afrigay.co.za
  21. Unscheduled extensions
    • It is understood that any expenses relating to unscheduled extensions will be for the passengers account.  Any loss due to delays will not be refundable.  Passengers must refer to their respective travel insurance purchased.
  22. General
    • This document, together with World Leisure Holidays’ invoice / itinerary, is the sole record of the agreement between the passenger, The Travel & Event Company and World Leisure Holidays. Neither The Travel & Event Company, World Leisure Holidays nor the passenger will be bound by any representation, warranty, and promise or amendments that are not recorded in this document, in any of our brochures, on our website or as stipulated by the CPA. 
    • No addition to these Standard Terms and Conditions will apply unless they are in writing and have been signed by an authorized representative of The Travel & Event Company and World Leisure Holidays. 
    • No indulgence that The Travel & Event Company and World Leisure Holidays may grant to the passenger will waive any of our rights. All costs and disbursements, including legal costs incurred by The Travel & Event Company and/or World Leisure Holidays in recovering damages and or payments, will be for the passenger’s account.
  23. Law & Jurisdiction
    • South African law and the jurisdiction of South African courts will govern the relationship between the passenger and The Travel & Event Company and World Leisure Holidays. The Travel & Event Company and World Leisure Holidays shall be entitled to institute any legal proceedings arising out of or in connection with this contract in any Magistrates Court having jurisdiction in terms of Section 28 of the Magistrates Court Act no. 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction
  24. ASATA
    • The Travel & Event Company and World Leisure Holidays are members of ASATA (Association of South African Travel Agents) and as such ascribe to and abide by its constitution and code of conduct.
  25. Data collection
    • The Travel & Event Company and World Leisure Holidays, through its affiliates and related entities, collects and processes Personal Information about its guests as part of its activities and in order to provide the service required, in accordance with applicable data protection laws. 
    • It is agreed that Personal Information and sensitive Personal Information shall be collected by The Travel & Event Company and World Leisure Holidays’ employees about all passengers during the booking process. The passenger further agrees that data collected by the organizers shall only be processed by:
      • The Travel & Event Company and World Leisure Holidays for the purposes for which the Personal Information has been collected and shall not be divulged to any third party save for any data which may be available in the public domain, as may be required by law or as provided for under section (b) hereafter;
    • The passenger declares that all Personal Information and sensitive Personal Information provided to the organizers is true and correct. The passenger acknowledges that any Personal Information provided to the organizers shall be kept for as long as required under the law. The passenger acknowledges that further information and details of World Leisure Holidays data protection policies and procedures can be provided to the passenger by the appropriate staff of World Leisure Holidays upon such a request made in accordance with the procedures set out.
